These Terms of Service apply to helixbj.net, helixjewelry.us, and related online storefronts operated by Helix Body Jewelry LLC, a New Mexico limited liability company (entity no. 0008013505), referred to as “Helix,” “we,” “us,” or “our.” By visiting the site, creating an account, or placing an order, you agree to these Terms and to the policies incorporated by reference.

1. Eligibility and acceptance

You must be of legal age in your place of residence, or use the site with the permission and supervision of a parent or legal guardian. You may not use the site or products for an unlawful purpose.

2. Products and information

Helix sells premium piercing jewelry, including 14K and 18K solid gold and ASTM F-136 implant-grade titanium pieces. We aim to present materials, dimensions, colors, and images accurately, but screen settings, handmade characteristics, natural stones, and production variations may cause minor differences. Product availability is subject to inventory.

Customers are responsible for checking material, gauge, length, diameter, closure system, and recommended placement before ordering. Our guidance is general information and does not replace advice from a qualified medical professional or professional piercer.

3. Prices, taxes, and payment

Prices are displayed in the currency assigned to the relevant market and may change without notice. The valid price is the price shown when the order is submitted, subject to correction of an obvious error. Shipping, taxes, duties, and other applicable charges are shown at checkout when available.

Payments are processed by secure third-party providers. Helix does not store complete payment-card details. The payment methods available to you are those displayed at checkout.

4. Orders

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may verify payment, identity, inventory, or shipping information. We may cancel or limit an order because of suspected fraud, payment failure, inaccurate information, inventory error, regulatory restrictions, or an obvious pricing or listing error. If we cancel a paid order, we will issue the appropriate refund to the original payment method.

5. Shipping and delivery

Orders are fulfilled from Colombia and shipped through tracked international carriers. Estimated dates are not guaranteed and can be affected by carriers, customs, weather, and events outside our reasonable control. The customer is responsible for providing an accurate address and, unless checkout states otherwise, for destination-country duties, taxes, or customs charges. Our Shipping Policy forms part of these Terms.

6. Returns, warranty, and authenticity

Because piercing jewelry is a hygiene-sensitive personal-use product, change-of-mind returns and exchanges are not accepted after delivery. Exceptions and remedies for an incorrect item, transit damage, missing contents, or a manufacturing defect are described in our Returns, Exchanges & Warranty Policy.

Titanium jewelry has a 3-month manufacturing warranty. Solid-gold jewelry has a 6-month manufacturing warranty. We guarantee the lifetime authenticity of jewelry sold as 14K or 18K solid gold; this authenticity commitment is not a lifetime damage warranty.

7. Proper use and sensitivities

Body jewelry must be selected, installed, worn, and cared for appropriately. Individual sensitivities vary, and we cannot guarantee that every customer will be free from irritation or an allergic reaction. Stop use and seek qualified advice if you experience a concerning reaction. Helix is not responsible for injury or damage caused by improper sizing, installation, handling, modification, or use contrary to product guidance, except where liability cannot legally be excluded.

8. Accounts and communications

You are responsible for maintaining the confidentiality of account credentials and for the accuracy of information submitted to us. Transactional messages may be sent by email, phone, or WhatsApp to manage an order or customer-service request. Marketing messages are sent only as permitted by applicable law and your choices.

9. Intellectual property

The site's photographs, videos, text, designs, graphics, logos, trademarks, and other content are owned by or licensed to Helix and are protected by applicable intellectual-property laws. You may use the site only for personal shopping and may not reproduce, distribute, modify, scrape, resell, or commercially exploit its content without written permission.

10. Prohibited conduct

You may not interfere with site security or operation; introduce malicious code; collect personal data without authorization; impersonate another person; submit false or fraudulent information; infringe intellectual-property or privacy rights; or use the site in violation of law.

11. Third-party services and links

The store is powered by Shopify and may rely on payment, shipping, analytics, customer-support, and marketing providers. Third-party services and websites operate under their own terms and privacy notices. We are not responsible for third-party content or service interruptions outside our reasonable control.

12. Disclaimers and limitation of liability

To the fullest extent permitted by law, the site and its content are provided on an “as available” basis. Helix does not guarantee uninterrupted or error-free access. To the fullest extent permitted by law, Helix will not be liable for indirect, incidental, special, punitive, or consequential losses arising from use of the site or products. Nothing in these Terms excludes liability or consumer rights that cannot be excluded under applicable law.

13. Indemnification

To the extent permitted by law, you agree to indemnify Helix from third-party claims arising from your unlawful use of the site, your violation of these Terms, or your infringement of another person's rights.

14. Governing law and disputes

These Terms are governed by the laws of the State of New Mexico and applicable United States federal law, without regard to conflict-of-law principles. Any dispute will be handled in the courts with proper jurisdiction in New Mexico unless mandatory consumer law requires another forum or process.

15. Changes, severability, and waiver

We may update these Terms by publishing a revised version and date. Changes apply prospectively unless the law permits otherwise. If a provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver.
